TERMS AND CONDITIONS OF THE APARTMENTS CLOSER TO HEAVEN JAGNIĄTKÓW
For the sake of your peaceful and safe stay in our apartments, we ask you to read and comply with these rules and regulations. For our part, we assure you that we will make every effort to ensure that the agreement concluded with you is carried out in a conscientious and careful manner.
§1 Subject of the Regulations
The Rules and Regulations define the rules for the provision of services, liability and stay on the premises of the Apartments Closer to Heaven Jagniątków and is an integral part of the contract, which is concluded by making a reservation, paying a deposit or the entire amount due for a stay in the Apartment, or by checking in. By performing the aforementioned actions, the Guest confirms that he/she has read and accepts the terms and conditions of the Regulations and undertakes to abide by them.
The Rules and Regulations are binding on all Guests staying in the Apartments, including third parties visiting Guests, to the extent applicable to them, and are available for review in each Apartment, as well as at .
Terms used in the Regulations shall be understood as:
Apartments – Apartments Closer to Heaven Jagniątków.
Area of the Apartments – the Apartment that is the subject of the lease and the outdoor area belonging to the Apartments Bliżej Nieba Jagniątków within the boundaries designated by the fence.
Owner of the Apartments – the person holding the legal title to the property housing the Bliżej Nieba Jagniątków Apartments.
Manager of the Apartments – a person appointed by the owner of the Bliżej Nieba Jagniątków Apartments to undertake activities on his behalf aimed at the implementation of the hotel service.
Guest – a person using the hotel service of the Bliżej Nieba Jagniątków Apartments.
Check-in time – the time of providing hotel service by Apartments Bliżej Nieba Jagniątków from 16:00 to 11:00.
Hotel service – short-term, generally available rental of the Apartments Bliżej Nieba Jagniątków and provision of related services within them.
Check-in – the collection by the manager of the Bliżej Nieba Jagniątków Apartments of information concerning the Guest, necessary for the realization of the hospitality service and for the security of the Apartments against possible claims.
Rules and Regulations – the rules for the provision of services, liability and stay on the premises of the Apartments Bliżej Nieba Jagniątków.
Rental Agreement – the agreement concluded between the Apartments Bliżej Nieba Jagniątków and the Guest for a short-term stay.
§2 Check-in time
The apartment is rented for hotel nights. Check-in time is from 16:00 to 11:00 the next day. Failure to return the keys by 11:00 a.m. means extension of the stay by another hotel day and charging an appropriate fee. Arrival and/or departure of the Apartment before or after the start of the hotel day, at times other than those indicated above, requires prior arrangement with the Apartment Manager.
The request to extend the hotel day should be reported to the manager of the Apartments immediately and will be granted depending on the availability of free Apartments.
§3 Reservation
Reservation can be made by phone, e-mail or website , providing the name of the person making the reservation on his/her own behalf or on behalf of a third party, telephone number and e-mail address to which confirmation of the reservation will be sent.
In order for the reservation to be binding, it is necessary to make a deposit payment of 30% of the amount due for the entire stay, within 48 hours from the date of receipt of the reservation confirmation by the Apartments. The date of payment of the deposit is the date the funds are credited to the Apartments’ bank account.
In case of written cancellation of the stay at the Apartments up to 30 days prior to the scheduled arrival, the deposit will be refunded in full. The deposit will not be refunded in the event of a later cancellation of the reservation or cancellation of the arrival regardless of the reasons.
The remaining amount due for the stay, is payable in cash or by credit card on the guest’s arrival.
Commencement of the stay by the Guest later or termination of the stay earlier than specified in the reservation date, for reasons beyond the control of the Apartments, does not result in a relative reduction of the fee for the stay and its refund.
The reservation is valid until 8:00 p.m. on the day of scheduled arrival, unless the Guest informs the manager of the Apartments of a later time of arrival, but no later than 11:00 p.m. After this time, the reservation is canceled.
§4 Check-in and conditions of stay
While checking in, the Guest should show the manager of the Apartments an identity document with a photograph.
Persons who are not registered in the Apartment may stay there as guests from 8:00 a.m. to 10:00 p.m., only in the presence of persons registered in the Apartment.
The Apartment Manager may refuse to provide hospitality services to a Guest who has previously blatantly violated the Rules and Regulations, in particular by causing damage to the property of the Apartments or the property of the Guest, damage to the Guest, the employees of the Apartments or other persons staying in the Apartment.
The Apartments are subject to curfew from 10:00 p.m. to 8:00 a.m. Failure to observe this rule may result in immediate termination of the rental agreement, and in extreme situations, moreover, the intervention of the Police. In the event of Police intervention reported by a third party, following which the owner of the Apartments is fined, the owner of the Apartments is entitled to a recourse claim for its reimbursement from the person whose unlawful behavior resulted in the imposition of a fine.
Guests of the Apartments are forbidden by shouting, noise, alarm or other prank, to disturb the peace and rest of the night both during and outside the hours of curfew. This applies to other Guests of the Apartments, as well as to residents of properties adjacent to the Apartments.
It is strictly forbidden in the Apartments to possess and consume intoxicants prohibited by law, as well as to consume alcohol in such quantities that you lose control of your behavior. The discovery of violations of this prohibition by the Manager of the Apartments, will result in the reporting of this fact to the Police and immediate termination of the contract without the right to a refund resulting from a shortened stay in the Apartment.
Smoking of nicotine products is prohibited on the premises of the Apartments, i.e. both in the rooms and in the common space. Violation of this prohibition will result in an obligation to pay the amount of PLN 700.
On the premises of the Apartments, i.e. both in the rooms and in the common space, it is forbidden to use weapons and ammunition, flammable, explosive and illuminating materials (so-called fireworks and fireworks), as well as to use candles, heaters, electric irons, electric heaters and other similar devices, which are not equipment of the Apartment.
It is forbidden to move around the Apartments in ski footwear, as well as to bring ski equipment or bicycles into the Apartments.
It is possible to stay in the Apartments with animals, after notifying the Apartment Manager and obtaining individual permission. It is forbidden to keep animals in the Apartments without prior notification to the manager and acceptance of the rules of stay of animals. Violation of this prohibition may result in immediate termination of the rental agreement without the obligation of the Owner of the Apartments, refund of the price paid for the stay.
The Apartments are not a hotel as defined by law. With this in mind, at the end of your stay, we ask you to do some basic cleaning of the apartment, kitchenette and bathroom, which means: washing up the dishes, emptying the refrigerator, putting the towels in one place in the bathroom, throwing away the trash.
Items left by the departing Guest and belonging to him/her will be kept by the Apartments for a period of 3 (three) months, after which they will become the property of the Apartments, unless the Guest orders them to be shipped at his/her expense during this period. The above does not apply to groceries.
During the stay, the Guest may order additional cleaning and/or replacement of towels and/or bedding by making a relevant request to the Apartment Manager. Such service is billed according to the price list in force at the Apartments.
When using the Apartments, you should always make sure that the internal and external entrance doors to the building, have been locked. The Apartments are not responsible for loss or damage, left in the Apartments: money, documents or other belongings of Guests. The Apartments are also not responsible for damage to or loss of vehicles belonging to the Guest or belongings left in them, even if these vehicles are parked in the parking area of the Apartments.
The Guest is obliged to notify the Apartment Manager of any noticed defects or missing equipment on the day of arrival.
In the event of damage caused to the property of the Apartments, due to intentional or unintentional fault of the Guest or a visitor, the Guest shall be held materially liable for the damage caused, up to the limits of full compensation, which also applies to deficiencies in the Apartment equipment noticed by the Apartment Manager. The Guest should notify the Apartment Manager of any damage to the property of the Apartments, immediately upon discovery of such fact.
It is forbidden in the Apartments to charge electric cars from the electric sockets, which are located in the Apartments and outside the Apartments
For damages caused by minors under the Guest’s care, the legal representatives of such minors are financially responsible.
When leaving the apartment, for safety reasons, remember to turn off the TV, turn off the lights, turn off the taps and lock the door.
The keys to the Apartment, entrusted to the Guest, may not be transferred by the Guest to third parties (i.e. those not checked in at the Apartments).
The Guest is obliged to inform the Manager of the Apartments about the loss of keys to the Apartment immediately after discovering this fact. If the keys are lost, the Guest will be charged 500 PLN.
Guests are not allowed to make any permanent changes to the Apartment and its equipment, except for minor rearrangement of furniture and equipment, not affecting their purpose, functionality and safety of use.
Violation by the Guest of any of the above conditions of stay, may result in termination of the rental agreement as soon as the Apartment Manager discloses this fact, without the obligation of the Apartment Owner to refund the fee paid for the remainder of the stay.
Children under the age of 12 should be in the Apartments under the constant supervision of their legal guardians. Due to the nature of the terrain adjacent to the Apartments (high slopes), Guests are asked to exercise extreme caution in the use of the outdoor area of the Apartments and to pay attention to the above underage children under their care. Special caution is also advised with regard to the use of firewood stoves, which may only be operated by adult Guests.
The court of local jurisdiction for the resolution of disputes between the Guest and the Owner of the Apartments is the Court in Jelenia Góra.
The Guest agrees for storing and processing of his/her personal data in accordance with the Personal Data Protection Act (Journal of Laws of 202, No. 101, item 926 as amended) by the Administrator of the personal data, for the needs necessary to realize the Guest’s stay in Bliżej Nieba Jagniątków Apartments and use of other services provided by Bliżej Nieba Jagniątków Apartments by the Guest. The Guest has the right to inspect his/her personal data and correct them. The person making the reservation is responsible for the truthfulness and correctness of the data provided in the reservation form. Bliżej Nieba Jagniątków Apartments are not responsible for incorrect selection of the date of stay or incorrect data entered by the Guest in the reservation form. In case of any irregularities that cannot be corrected by editing the reservation, the Guest should immediately contact the manager of Apartments Bliżej Nieba Jagniątków. REGULATIONS FOR THE STAY OF ANIMALS IN BUNGALOWS BCloser Nieba Jagniątków
Guests with their dogs are cordially invited to the Domki Bliżej Nieba Jagniątków. We kindly ask you to familiarize yourself with the conditions under which we offer the stay of animals.
The only pets allowed are dogs.
We do not accept dogs generally considered dangerous or aggressive, including such dogs as the American pit bull terrier, Mallorquin dog (Perro de Presa Mallorquin), American bulldog, Argentine dog, Canary dog (Perro de Presa Canario), tosa inu, rottweiler, akbash dog, anatolian carabash, Moscow guard dog, Caucasian sheepdog.
The first, basic condition that must be met in order for your pet to be accepted under our roof is to notify the arrival with him at the time of booking.
Your pet’s stay at Domki Bliżej Nieba Jagniątków is conditional on having a valid health booklet with current vaccinations and deworming certificate. In case of its absence, we provide guests with the phone number of the veterinarian. We do not accept sick animals.
The owner is responsible for any damage caused by the animal. If the bedding, furniture or other items in the room where the animal is staying are soiled by the animal (hair, mud), the owner will be charged for additional laundry services.
Pet owners are responsible for their behavior on the premises of the Cottages (especially quietness) and not disturbing other Guests. In the case of repeated complaints from other Guests, we reserve the right to request that the animal be removed from the apartment.
In public areas, dog owners are required to keep their dogs on a leash and muzzled. In the area surrounding the Cottages, the owner is obliged to clean up the excrement left by their pet.
